Increased fines for violating personal data policy
Starting from 27 March 2021, fines for violations of personal data legislation have been increased. The increase in fines has affected almost all the violations provided for by Article 13.11 of the Code of Administrative Offences of the Russian Federation.
For a number of administrative offences, the possibility of imposing a sanction in the form of a warning without imposing a fine has also been cancelled.
In addition, the changes provide for an increase in period of limitation for the institution of administrative proceedings in relation to the legislation on personal data (Article 4.5 of the Code of Administrative Offences of the Russian Federation) – the period has been increased from three months to one year.
Mazars' legal team has prepared a comparative overview of changes in liability for violations of personal data legislation (hereinafter - 'PD') applicable to the activities of private businesses.
